San Diego Tenants Organize Utility Bill Strike Over Soaring RUBS Charges
Michael Parker, a resident of La Suzanna apartments in San Diego's Bankers Hill, experienced a significant increase in his utility bill, from a flat $60 to over $170, after his landlord, Income Property Advisors, Inc., implemented a Ratio Utility Billing System (RUBS) through third-party company Livable. This system, which divides property-wide utility costs among tenants based on factors like occupancy rather than individual meter usage, led to similar bill shocks for 15 other units.
Tenants, already friendly, organized a "utility bill strike" and demanded to see the building's actual utility bills. They leveraged San Diego’s Residential Utility Fee Ordinance, which prohibits landlords from charging tenants more than the city bills for utilities and requires transparency. After the demand, the property manager provided the bills, revealing a nearly $4,000 monthly trash bill. Tenants contested the frequency of trash collection, leading to a $500 reduction in the trash bill.
Despite this adjustment, residents remain concerned about the burden of monitoring utility costs and the lack of transparency in RUBS formulas. This case highlights the complexities of utility billing in multi-unit properties and the increasing importance of local regulations in protecting tenant interests and ensuring fair practices in property management.
